These Terms of Service (“Terms”) govern your use of bayareaboudoirphotographers.com and related pages (the “Site”), operated as an editorial project of the League of Extraordinary Boudoir Photographers (“we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. What this Site is
The Site is an editorial directory and research guide to boudoir photographers working in the San Francisco Bay Area, including San Francisco, the East Bay, the Peninsula, the South Bay, Marin, Napa, and Sonoma.
The Site is not a photography studio. You cannot book a session here. We do not take deposits, schedule shoots, provide hair and makeup, deliver images, or act as an agent, broker, or representative for any photographer.
Lists, rankings, comparisons, and “best of” language on the Site are opinions. They are not certifications, awards from a government or trade body, guarantees of quality, or promises about a future session.
2. How listings work
We research photographers from publicly available sources, including websites, published pricing, portfolios, and client feedback, and we publish what we find. A listing is not a paid placement. Featured placement is not for sale.
We may add, edit, reorder, or remove a listing at any time, with or without notice. Inclusion does not create a partnership, endorsement contract, or obligation to keep a photographer listed. Omission is not a statement that a photographer is unqualified.
Session details, prices, locations, team makeup, and contact information are compiled from public sources and can change. Confirm anything that matters — price, what is included, location, and who will be in the room — with the photographer before you book.
3. Your relationship is with the photographer
If you contact or book a photographer named on the Site, that relationship is solely between you and that photographer. Their contract, pricing, cancellation policy, model release, and image-use terms control the session.
We are not a party to that agreement. We are not responsible for a photographer’s conduct, punctuality, editing, delivery, refunds, studio safety, or use of your images. Complaints about a session should go to the photographer.
4. Age
Boudoir photography involves intimate and sometimes nude portraiture. The Site is meant for adults. You must be at least 18 to use the Site. We do not knowingly collect information from anyone under 18.
5. Intellectual property
The Site’s text, selection and arrangement of listings, graphics, and branding are owned by us or our licensors and are protected by copyright and trademark law. You may share a link to a page. You may not copy, scrape, republish, or resell the listings, rankings, or page copy for a competing directory or commercial use without written permission.
Photographs on the Site belong to the photographers who made them, or to their clients, as applicable. They are shown for identification and commentary. A photo credit is not a license for you to reuse the image.
Names of photographers and studios are the property of their owners. Listing a name is not a claim that we own that brand.
6. Corrections and submissions
Photographers and readers may send corrections. Include links or other records that show what is wrong. We review corrections the same way we build lists: research first. We do not promise a reply, a change, or a particular placement.
If you send us text, links, or other material, you represent that you have the right to send it, that it is accurate to the best of your knowledge, and that it does not infringe anyone’s rights. You grant us a non-exclusive, royalty-free license to use that material to operate, correct, and publish the Site.
Do not send private client images, session files, or anything a client has not cleared for sharing.
7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose
- Scrape, harvest, or systematically copy listings or contact details
- Interfere with the Site’s security or operation
- Post spam, impersonate another person, or submit false corrections
- Use listing content to mislead clients about an affiliation with this Site
We may block access or remove comments that break these Terms.
8. Comments
If comments are enabled, you are responsible for what you post. We may moderate, edit, or delete comments. Comment data is handled as described in the Privacy Policy.
9. Third-party sites
Links to photographer websites, social profiles, and embedded content leave our Site. Those sites have their own terms and privacy practices. We do not control them and are not responsible for their content, availability, or data practices.
10. Disclaimer
The Site is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that listings are complete, current, or error-free, that a named photographer is available, licensed, or insured, or that a session will meet your expectations.
11. Limitation of liability
To the fullest extent allowed by California law, we and our operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of a session, arising out of your use of the Site or your dealings with a listed photographer.
Our total liability for a claim relating to the Site will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us to use the Site in the twelve months before the claim. Use of the Site is free.
Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the maximum extent the law allows. Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud or willful misconduct.
12. Indemnity
You will indemnify and hold us harmless from claims, damages, and reasonable legal fees arising out of your misuse of the Site, your submissions, or your violation of these Terms or of someone else’s rights.
13. Copyright complaints
If you believe material on the Site infringes your copyright, send a notice that includes:
- Your physical or electronic signature
- Identification of the work claimed to be infringed
- Identification of the material and its URL
- Your contact information
- A statement that you have a good-faith belief the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner
Send notices to the contact address below. We may remove material and, where appropriate, terminate repeat infringers.
14. Privacy
Our Privacy Policy explains what we collect and how we use it. The Site is not directed at children, and we do not sell personal information.
15. Changes
We may update these Terms by posting a new version on this page and changing the “Last updated” date. Continued use after the new date means you accept the updated Terms. If a change is material, we will make a reasonable effort to note it on this page.
16. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts located in California have exclusive jurisdiction over disputes arising out of these Terms or the Site, except where the law gives you the right to bring a claim elsewhere.
17. Miscellaneous
If a provision of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about use of the Site. They do not create a partnership, joint venture, or agency.
